Abstract

This research addresses important issues related to interrogation during the preliminary investigation phase. This phase is the most important stage of the investigation conducted by the competent authorities, as the interrogation of the accused at this stage requires conditions and real guarantees. Perhaps the most important of these conditions is that the investigator presumes innocence when interrogating the accused. The interrogation should also be recorded paragraph by paragraph, and it must take place in normal circumstances that do not affect the accused, so that information can be obtained from its sources without difficulty, provided that a report is made in accordance with specific conditions. It is also important to follow a precise scientific approach when interrogating special categories of defendants, such as women, juveniles, the elderly, and people with special needs.
